That question comes up in almost every organisation.

It's a fair question. The kind asked in good faith, usually right after approving the EAP budget or fielding concerns from a worried manager.


But it's also the question that reveals everything about how an EAP handles the line between insight and surveillance.

No identifiable data (names, job titles, team locations, or any combination that could point back to a person). No small-group reporting, even if it's technically anonymised, because a five-person department knows exactly who's who. And no profiling, no risk-scoring, no heat maps that try to predict who might be "at risk."


In Switzerland, medical confidentiality (Arztgeheimnis) is protected under Swiss Criminal Code Art. 321 and reinforced in federal guidance; disclosure is limited to patient consent or narrowly defined legal/safeguarding exceptions, not organisational performance questions.

So instead of burying reassurances in a 12-page policy, say this:


"Your conversations are private. Your employer will never see your name, your sessions, or what you talk about. They'll only see anonymous trends across the whole organisation, and only when enough people are using the service to protect everyone's privacy. Nothing you share will ever be used to assess your performance, question your commitment, or influence decisions about your role."

It's direct. It's clear. And it works.


Managers, whether in the office or on the production floor, can reinforce this without turning it into surveillance. Equip them with a simple talk track that works for shift teams: make it clear that accessing support won't affect their overtime, their standing, or their job security.

EAPs exist for people at their most vulnerable. When confidentiality is compromised (or even just perceived to be compromised), the damage is hard to reverse.


But when organisations get this right, three things happen.


  1. Utilization goes up. People use services they actually trust.

  2. Insight gets better. Honest engagement produces more reliable patterns than surveilled caution ever could.

  3. Risk goes down. Ethical restraint reduces legal exposure, reputational damage, and the moral cost of getting it wrong.
